For Employers:
By using the Legal Spiel Jobs Board (“the Service”) to post job listings, you (“Employer,” “you,” or “your”) agree to be bound by the following terms and conditions:
1. Job Postings:
The Employer is solely responsible for the accuracy, completeness, and legality of all job postings submitted to the Service. All postings must comply with all applicable Irish and European Union laws and regulations, including but not limited to those concerning equal opportunities, data protection, and non- discrimination. Legal Spiel (“we,” “us” or “our”;) assumes no liability for any inaccuracies, omissions, or non-compliance in Employer postings. We reserve the unilateral right to remove any posting at any time, with or without notice, for any reason, including but not limited to violation of these Terms of Use or applicable laws.
2. Prohibited Content: Job postings must not:
(a) solicit any personal information from applicants that is protected under data
privacy regulations (including, but not limited to, age, sexual orientation, health
status, religious or political beliefs, ethnicity, or trade union membership);
(b) infringe upon any intellectual property rights, including copyright;
(c) utilize any account other than your own;
(d) contain images of children;
(e) violate any applicable laws or regulations.
3. Copyright:
All content on the Service, including but not limited to text, graphics, and logos, is protected by copyright and other intellectual property laws. The Employer may not reproduce, distribute, or create derivative works from any Service content without our express written consent.
4. Job Advertisement Guidelines:
- Only one advertisement per job posting is permitted.
- Job descriptions must be clear, concise, and accurate.
- Employers are responsible for regularly reviewing and responding to
applications. - The application deadline stated in the posting is binding.
- The Employer is solely responsible for managing all communication and
interactions related to their job posting. - Use of company logos is permitted, provided they do not violate any
intellectual property rights.
5. Candidate Responses:
Legal Spiel makes no guarantee regarding the number or quality of responses received to Employer job postings.
6. Prohibited Use:
The Employer may not use the Service in any manner that could damage, disable, overburden, or impair our services, or that constitutes unfair competition with our business, as determined by us in our sole discretion. Unauthorized access to or use of another user’s account is strictly prohibited.
7. Privacy:
Our Privacy Policy, incorporated herein by reference, governs the collection, use, and disclosure of personal data.
8. Indemnification:
The Employer agrees to indemnify Legal Spiel, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with the Employer’s use of the Service, violation of these Terms of Use, or violation of any applicable law or regulation.
9. Warranty Disclaimer:
The Service is provided “as is” and without warranty of any kind. Legal Spiel disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability:
In no event shall Legal Spiel be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the Employer’s use of the Service, regardless of the cause of action and even if Legal Spiel has been advised of the possibility of such damages.
11. Payment Terms (if applicable):
If the service involves payment, clear and detailed payment terms will be included, specifying payment methods, deadlines, and consequences of late payment. Please note that this protects Legal Spiel’s financial interests.
12. Termination:
Legal Spiel may terminate the Employer’s access to the Service at any time, with or without cause or notice. Termination will not affect any accrued rights or liabilities of either party.
For Job Applicants:
By submitting a job application through the Service, you (“Applicant,” “you,” or “your”) agree to the following:
1. Data Privacy:
Our Privacy Policy, incorporated herein by reference, governs the collection, use, and disclosure of your personal data. Your application will be retained for a period of 12 months and then automatically deleted unless otherwise required by law.
2. Representation and Warranties:
The Applicant represents and warrants that all information provided in their application is true, accurate, and complete. The Applicant agrees to update their information as needed to maintain accuracy.
3. Intellectual Property:
The Applicant retains ownership of any intellectual property rights in their application materials. However, by submitting their application, the Applicant grants Legal Spiel a non-exclusive, royalty-free, worldwide license to use, reproduce, and display the application materials solely for the purpose of facilitating job applications.
4. Release:
The Applicant releases Legal Spiel from any and all liability arising out of or in connection with their use of the Service or their interactions with Employers.
General Clauses for Employers and Applicants:
1. Dispute Resolution:
Disputes arising under these Terms of Use shall be resolved through binding arbitration in accordance with Republic of Ireland laws.
2. Entire Agreement:
These Terms of Use constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior or contemporaneous communications and proposals, whether oral or written.
3. Severability:
If any provision of these Terms of Use is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
4. Waiver:
No waiver of any provision of these Terms of Use shall be deemed a further or continuing waiver of such provision or any other provision.
Governing Law:
These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Ireland, and any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Ireland.
